Re: Smart Pass Program Expiration

The Tennessee Department of Revenue would like to inform you that the Smart Pass program our department administered has ended, due to the expiration of a federal law. You are receiving this letter because our records indicate you may have received a Smart Pass decal.

Under the Smart Pass program, which began in 2009, owners of low emissions and energy efficient vehicles could apply for a decal permitting them to drive in the high occupancy vehicle (HOV) lanes at any time on Tennessee interstates, regardless of the number of passengers present in their vehicle. Recently, the Federal Highway Administration (FHWA) sent official notice to Tennessee of the expiration of the exemption for all previously allowed low emission and energy efficient vehicles (LEEEV) in HOV lanes.

Due to the expiration of this federal law, the Smart Pass program has ended in Tennessee. Therefore, the HOV smart pass decal shown below is no longer valid. Please remove the decal at your earliest convenience. LEEEVs will now be treated as either a single occupant vehicle or HOV.
